Builderbond Terms and Conditions

The following Builderbond Terms and Conditions (the “Terms”) govern event registration and attendance of a Builderbond conference (“Builderbond”) presented by Buildertrend Solutions, Inc., its subsidiaries, and affiliates (collectively, “Buildertrend”). By registering for Builderbond or attending Builderbond (“Registrant”), you are stating that you agree to be bound by all of the terms and conditions set forth in these Terms governing registration and attendance of Builderbond. Registration and attendance of Builderbond is offered to you conditioned on acceptance, without modification, of the terms, conditions, and notices contained herein. You agree that you have obtained the consent of your employer, to the extent your employer may so require, prior to becoming bound by these Terms.

1. Fee and Payment

The registration fee per Registrant is set forth on the registration form (the “Registration Fee”). Full payment of the Registration Fee will be due and collected upon submission of the registration form. Full payment of the Registration Fee for all Registrants in a group is required for the group to gain access or entry to Builderbond. All payment obligations are non-cancelable and all Registration Fees paid are non-refundable unless otherwise expressly provided for herein.

2. Registrant Substitution and Cancellation

2.1 Substitution. Registrant may substitute a different attendee without charge up to 24 hours prior to the start of the Builderbond session. To substitute attendees, Registrant must send a notification of the substitution to events@buildertrend.com. Include the name of the new attendee and who they are replacing.

2.2 Cancellation. To receive a refund on Registration Fees, Registrant must submit a request to cancel within seven (7) calendar days of the date of submission of the registration form and at least fourteen (14) days before the Builderbond session. To cancel, a Registrant must submit an email request to events@buildertrend.com with “CANCELLATION” in the subject line. Any cancellations received after seven (7) calendar days of submission of the form and less than fourteen (14) days before the Builderbond session will not receive a refund.

3. Cancellation by Buildertrend

Buildertrend reserves the right to cancel any Builderbond session due to insufficient enrollment by providing notice to Registrant at least seven (7) calendar days prior to the scheduled commencement date. Buildertrend reserves the right to cancel a session due to circumstances beyond its reasonable control (e.g., weather, natural disaster) at any time. In the event of cancellation by Buildertrend, Registrant will receive a full refund of Registration Fees paid. Buildertrend will not be responsible for non-refundable travel tickets purchased or reservations made by Registrant.

4. Admittance and Attendance Guidelines

The following obligations apply to all Registrants:

Each Registrant must be twenty-one (21) years of age or older;
A valid photo ID (either a government issued identification or driver’s license card or a passport) will be required upon arrival at Builderbond;
Buildertrend reserves the right to deny admittance to Builderbond to anyone who has registered under false or erroneous pretenses (e.g., using another attendee’s name, individuals who are underaged, etc.) and to retain any Builderbond Registration Fees previously submitted for such registrations;
Buildertrend reserves the right to refuse or revoke Builderbond registration and admission to any individual, at its sole discretion;
Smoking is not permitted within Builderbond premises; and
Possession or use of illegal or controlled substances, or possession or use of firearms or other deadly weapons is strictly prohibited.

5. Code of Conduct

Buildertrend is dedicated to providing a harassment free experience for everyone, regardless of gender, gender identity and expression, age, sexual orientation, disability, physical appearance, body size, race, ethnicity, national origin, religion (or lack thereof), or technology choices. We do not tolerate harassment or inappropriate behavior at Builderbond or any of our events in any form. Sexual or discriminatory language and imagery is not appropriate for any venue, including personal space, presentations, workshops, parties, social media, and other online media. Registrants violating these rules may be sanctioned or expelled from Builderbond or our venues at the discretion of Buildertrend or the staff and without a refund. Please bring any concerns to the immediate attention of the Buildertrend team.

6. Content and Materials

6.1 Proprietary Content. Buildertrend reserves the right to (a) limit, restrict or prohibit audio or video recordings and/or transmissions of Builderbond or any portion thereof, or the taking of photographs during Builderbond, and (b) remove anyone conducting unauthorized recordings or photography. Any Registrant who conducts unauthorized recordings or photography after being notified by Buildertrend that such recordings or photography are so limited, restricted, or prohibited hereby (w) transfers ownership of any and all unauthorized recordings of Builderbond (i.e., tape, CD, or such other medium) to Buildertrend or its assigns, (x) agrees, upon request, to give possession of all copies of any such unauthorized recordings to Buildertrend before leaving the Builderbond premises, (y) and authorizes use of any such unauthorized recordings of Builderbond (tape, CD, or such other medium) by Buildertrend and/or its assigns for any purpose.

6.2 Registrant Content. Subject to the Proprietary Content Section and the other restrictions herein, Buildertrend permits Registrants to capture and share their personal experiences at Builderbond through photographs, audio recordings, video recordings, livestreams, and social media posts (“Registrant Content”), including posts to the Registrant’s own social media accounts, with use of any official Builderbond hashtags encouraged. Registrant Content may not be sold, licensed, monetized, used in advertising, used to train artificial intelligence or machine-learning models, or otherwise exploited commercially without Buildertrend’s prior written consent, and must not (i) imply any sponsorship, endorsement, or affiliation with Buildertrend that does not exist, (ii) be created in any session, area, or of any materials that Buildertrend designates as restricted or “no-recording” (in which case the Proprietary Content Section controls), (iii) capture other Registrants’ private conversations, (iv) infringe or violate any intellectual property, publicity, privacy, contract, or other right of any third party, (v) include any confidential or proprietary information of Buildertrend, any sponsor, exhibitor, speaker, or other Registrant, (vi) include any individual who has not consented to being recorded and to the posting and distribution of such Registrant Content, or (vii) disparage or defame Buildertrend, its affiliates, employees, sponsors, exhibitors, speakers, vendors, or other Registrants, or portray any of them in a false or misleading light. Each Registrant hereby grants Buildertrend and its assigns a non-exclusive, worldwide, royalty-free, sublicensable, transferable, and perpetual license to use, reproduce, distribute, publicly display and perform, modify, and create derivative works of any Registrant Content posted publicly or shared with Buildertrend, in any media, for any lawful purpose. Buildertrend has no obligation to monitor Registrant Content and reserves the right, in its sole discretion, to require removal or editing of any Registrant Content, revoke a Registrant’s permission to create or post Registrant Content, and remove from the Builderbond premises any Registrant who fails to comply.

6.3 Views. The views expressed by any conference attendee, speaker, exhibitor or sponsor are not necessarily those of Buildertrend or its affiliates. All conference attendees, speakers, exhibitors and sponsors are solely responsible for the content of any and all individual or corporation presentations, marketing collateral, advertising, and online web content.

7. Likeness

From time to time, Buildertrend and its sponsors, vendors, and other contracted third parties may take photos or videos at Builderbond. By attending Builderbond, each Registrant permits, authorizes, and consents Buildertrend to use the Registrant’s name, comments, and likeness in photographs, videos, motion pictures, advertising, promotion, performance, or sound recordings for any purpose or purposes, including, but not limited to, publicizing or marketing Buildertrend or Builderbond or for any other commercial or lawful purpose, without any compensation due to the Registrant. Registrant further waives any claim in connection with the above use or uses including, but not limited to, rights of privacy or publicity, confidentiality, copyright, or otherwise. Registrant understands and agrees that these materials will become the property of Buildertrend and will not be returned. Registrant will hold harmless, release, and forever discharge Buildertrend from all claims, demands, and causes of action which Registrant, their representatives, or any other persons acting on the Registrant’s behalf have by reason of this authorization.

8. Third Party Suppliers

Buildertrend acts solely as a conference host and works with supplier venues, hotels, ground transportation, and other independent contractors providing services such as accommodations, transportation, and/or other services (“Supplier(s)”). Each Supplier is an independent entity and is not subject to the control of Buildertrend. Buildertrend shall not be liable for any actions, errors, or omissions of Suppliers. Registrants acknowledge and agree that any arrangements made with Suppliers are made solely between Registrants and Suppliers and Buildertrend shall not be responsible for any loss, damage, injury, delay, or inconvenience caused by Suppliers.

9. Warranty

Buildertrend warrants that its personnel are suitably qualified and experienced to present, train, and teach at Builderbond. Except as expressly represented otherwise, and to the extent not prohibited by law, all workshops, presentations, and information provided at Builderbond, including any advice, guidance, suggestions, recommendations, documentation, publications, software programs or code, and other information provided by or on behalf of Buildertrend or its Suppliers to Registrant is furnished on an “AS-IS” basis, without warranty of any kind, whether express, implied, statutory or otherwise especially as to quality, reliability, timeliness, usefulness, sufficiency, accuracy, or results. ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ALL IMPLIED WARRANTIES OF CONDITION, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED BY BUILDERTREND AND ITS SUPPLIERS. NO ORAL OR WRITTEN INFORMATION PROVIDED BY BUILDERTREND SHALL CREATE A WARRANTY UNLESS INCORPORATED INTO THESE TERMS.

10. Limitations of Liability

In consideration for being permitted to attend and participate in Builderbond, Registrant, and their personal representatives, heirs, and next of kin, hereby accepts any and all risks associated with and/or in any way related to Builderbond, known and unknown, and agrees to be solely responsible for Registrant’s own safety and to take every precaution to provide for Registrant’s own safety and well-being while attending and/or participating in Builderbond.

In further consideration of being permitted to attend and participate:

REGISTRANT HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Buildertrend or its respective members, managers, shareholders, directors, officers, employees, and agents (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or relating to any loss, damage or injury, including death, that may be sustained by Registrant, or to any property belonging to Registrant, whether caused by the negligence of Released Parties, or any other person while Registrant is in, on or about the Buildertrend premises located at 11818 I Street, Omaha, NE (the “Facility”) and/or attending Builderbond.
REGISTRANT HEREBY AGREES TO INDEMNIFY, SAVE AND HOLD HARMLESS the Released Parties, and each of them, from any loss, liability, damage or cost they may incur as a result of Registrant’s presence in, on or about the Facility or Registrant’s attendance at Builderbond, and that in the event that any claim is made against any of the Released Parties, Registrant will defend and fully indemnify the Released Parties for any such claim and all expenses related thereto, including attorney’s fees and costs.
REGISTRANT HEREBY ASSUMES FULL AND COMPLETE RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE due to the negligence of any Released Parties or otherwise while Registrant is in, on or about the Facility and/or attending Builderbond.

11. Privacy Policy

Buildertrend’s Privacy Notice is hereby incorporated as part of these Terms.

12. Choice of Law and Venue

The laws of the State of Nebraska, in the United States, will govern these Terms, as well as any claim, cause of action or dispute that might arise between Registrant and Buildertrend (a “Claim”), without regard to conflict of law provisions. FOR ANY CLAIM BROUGHT BY EITHER PARTY, YOU AGREE TO SUBMIT AND CONSENT TO THE PERSONAL AND EXCLUSIVE JURISDICTION IN, AND THE EXCLUSIVE VENUE OF, THE STATE AND FEDERAL COURTS LOCATED WITHIN DOUGLAS COUNTY, NEBRASKA.
