Additional U.S. State Privacy Disclosures

These Additional U.S. State Privacy Disclosures (“Disclosures”) supplement the information contained in our Privacy Policy by providing additional information about our personal information processing practices relating to individual residents of states with comprehensive privacy laws. For a detailed description of how we collect, use, disclose, and otherwise process personal information in connection with our Services, please visit our Privacy Policy. Unless otherwise expressly stated, all terms defined in our Privacy Policy retain the same meaning in these Disclosures.

I. Sales, Sharing, And Targeting Advertising

As further described in the Our Disclosure of Personal Information section of the Privacy Policy, we may “sell” or “share” your personal information with third parties for targeted advertising purposes, subject to your right to opt out (see Your Privacy Choices below).

The categories of third parties to whom we may “sell” personal information to or “share” personal information with include:

  • Ad networks and advertising partners;
  • Business partners, including marketing partners;
  • Analytics providers; and
  • Social networks.

We may also disclose personal data for the purposes described in the Our Disclosure of Personal Information section of our Privacy Policy.

II. Sensitive information

The following personal data elements we collect may be classified as “sensitive” under certain privacy laws (“sensitive information”):

  • Social security, driver’s license, state identification card, or passport number;
  • Account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account;
  • Precise geolocation; and
  • Contents of a consumer’s mail, email, or text messages (unless the company is the intended recipient of the communication)

We use this sensitive information for the purposes set forth in the Our Collection and Use of Personal Data section of our Privacy Policy, as necessary to operate our services, to enter into and perform a contract with you, to comply with legal and regulatory requirements, to protect the life or physical safety of you or others, or as otherwise permissible for our internal business purposes consistent with applicable laws.

We do not sell sensitive information, and we do not process or otherwise share sensitive information for the purpose of targeted advertising. However, depending on your state of residency and subject to certain legal limitations and exceptions, you may be able to limit, or withdraw your consent for, our processing of sensitive information (as described in the Your Privacy Choices section below), except for where the processing of your sensitive information is necessary to provide you the services or otherwise required by law.

III. Your Privacy Choices

In accordance with applicable privacy law, and depending upon the jurisdiction in which you reside, you may have some or all of the following rights in respect of your personal information:

  • Right of access. You may have the right to obtain:
    • confirmation of whether, and where, we are processing your personal information;
    • information about the categories of personal information we are processing, the purposes for which we process your personal information and information as to how we determine applicable retention periods;
    • information about the categories of recipients with whom we may share your personal information; and
    • a copy of the personal information we hold about you.
  • Right of portability. You may have the right, in certain circumstances, to receive a copy of the personal information you have provided to us in a structured, commonly used, machine-readable format that supports re-use, or to request the transfer of your personal information to another person.
  • Right to rectification or correction. You may have the right to obtain rectification or correction of any inaccurate or incomplete personal information we hold about you.
  • Right to deletion or erasure. You may have the right, in some circumstances, to require us to delete erase your personal information.
  • Right to opt-out. You may have the right to opt-out of certain processing activities. For example, you may have the right to opt-out of the use of your personal information for targeted advertising purposes, or to “sell” or “share” your personal information with third parties in certain contexts.
  • Right to control over automated decision-making/profiling. The right to direct us not to use automated decision-making or profiling for certain purposes.
  • Right to appeal. In the event that we decline to take action on a request exercising one of your rights set forth above, you have the right to appeal our decision.
    • Colorado Residents: If your appeal is denied, you may contact the Colorado Attorney General to address your concerns here.
    • Connecticut Residents:If your appeal is denied, you may contact the Connecticut Attorney General to submit a complaint here.
    • Virginia Residents: If your appeal is denied, you may contact the Virginia Attorney General to submit a complaint here.

Depending on your state of residency, you may also have the right to not receive retaliatory or discriminatory treatment in connection with a request to exercise the above rights. However, the exercise of the rights described above may result in a different price, rate or quality level of product or service where that difference is reasonably related to the impact the right has on our relationship or is otherwise permitted by law.

Before processing your request, we will need to verify your identity and confirm you are a resident of a state that offers the requested right(s). In order to verify your identity, we will generally either require the successful authentication of your account, or the matching of sufficient information you provide us to the information we maintain about you in our systems. We may at times need to request additional personal data from you, taking into consideration the sensitivity of your request.

In certain circumstances, we may decline a request to exercise the rights described above, particularly where we are unable to verify your identity or locate your information in our systems.

2. To Exercise Your Opt-Out Rights

As is common practice among companies that operate online, we do allow certain third-party advertising networks, social media companies and businesses partners to collect information directly from your browser or device through cookies or similar tracking technology when you visit or interact with our website, use our apps or otherwise engage with us online. These third parties may use such information for their own purposes in accordance with their own privacy policies, which may include reselling this information to additional third parties, including other advertising networks.

These third parties use this personal data to serve relevant targeted ads on other websites or mobile apps, or on other devices you may use, or to personalize content and perform other advertising-related services such as reporting, attribution, analytics and market research.     We recognize the “Global Privacy Control” (“GPC”) to allow you to opt out of the sale of your personal information and the sharing of your personal information for targeted advertising on our public facing Sites. The GPC is a proposed specification designed to allow Internet users to notify businesses of their privacy preferences, such as whether or not they want their personal information to be sold or shared. To learn more about the GPC and how you can use it to opt out of the sale or sharing of your personal information you can visit their website here. If you visit our public facing Sites with a browser transmitting GPC, we will not share your information for targeted advertising or sell your personal information associated with your visit.
  • For Non-Cookie-Based Opt-Outs: You may submit a request by filling out our online form in Section IX of our Privacy Policy.

3. Submitting Authorized Agent Requests

In certain circumstances, you are permitted to use an authorized agent to submit requests on your behalf through the designated methods set forth above where we can verify the authorized agent’s authority to act on your behalf. In order to verify the authorized agent’s authority, we generally require evidence of either (i) a valid power of attorney or (ii) a signed letter containing your name and contact information, the name and contact information of the authorized agent, and a statement of authorization for the request. Depending on the evidence provided and your state of residency, we may still need to separately reach out to you to confirm the authorized agent has permission to act on your behalf and to verify your identity in connection with the request.

4. Appealing Privacy Rights Decisions

Depending on your state of residency, you may be able to appeal a decision we have made in connection with your privacy rights request. All appeal requests should be submitted by emailing us at privacy@buildertrend.com with the subject line, “Privacy Request Appeal.”

5. Minors

We do not sell the personal information and do not have actual knowledge that we sell the personal information of minors under 16 years of age. If we wish to do so in the future, we will first seek affirmative authorization form either the minor who is between 13 and 16 years of age, or the parent or guardian of a minor less than 13 years of age. Please contact us at privacy@buildertrend.com to inform us if you, or your minor child, are under the age of 16. 

If you are under the age of 18 and you want to remove your name or comments from our website or publicly displayed content, please contact us directly at privacy@buildertrend.com. We may not be able to modify or delete your information in all circumstances.

If you wish to submit a privacy request on behalf of your minor child in accordance with applicable jurisdictional laws, you must provide sufficient information to allow us to reasonably verify your child is the person about whom we collected personal information and you are authorized to submit the request on your child’s behalf (i.e., you are the child’s legal guardian or authorized representative).

6. Shine the Light Disclosure

The California “Shine the Light” law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes.
